Terms and Conditions

These Terms and Conditions apply to your use of this website and to purchases made from Magenta Audio Pty Ltd (Magenta Audio, we, us or our). By placing an order with us, you agree to these terms. If any part of these terms conflicts with a right or remedy you have under the Australian Consumer Law, that right or remedy prevails.

1. Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). These include guarantees that goods are of acceptable quality, match their description, are fit for any purpose you make known to us, and that services are provided with due care and skill.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified. Manufacturer warranties and any voluntary warranties we offer are additional to your ACL rights and do not replace them. 2. Product information and availability

We aim to ensure product descriptions, photographs, specifications, pricing and availability are accurate. Images may show optional accessories or finishes, and colours may vary between screens. If a specification, price or availability statement contains a genuine error, we will contact you as soon as reasonably possible and give you the option to proceed on the corrected basis or receive a full refund of any amount paid.

Products may be discontinued, allocated, made to order or subject to supplier availability. An indication that an item is available is not a guarantee that it can be supplied until we accept your order.

3. Orders and acceptance

Submitting an order or accepting a quotation is an offer to purchase. We may verify payment, delivery details and product availability before accepting the order. An order is accepted when we confirm acceptance or dispatch the goods, whichever occurs first.

We may decline or cancel an order before acceptance for legitimate reasons, including unavailability, an obvious pricing error, suspected fraud or an inability to deliver to the supplied address. If we do so after payment, we will refund the amount paid using the original payment method.

4. Prices, GST and payment

Unless stated otherwise, prices are in Australian dollars and include GST. Delivery, installation and other charges will be disclosed before you commit to the purchase or included in an accepted quotation.

Payment must be made using an available payment method or as agreed in writing. You must be authorised to use the payment method and provide accurate billing information. Title to goods passes to you when we receive payment in full. This does not affect when risk passes under our Delivery Policy.

5. Order changes and cancellations

Contact us promptly if you need to change or cancel an order. We will accommodate requests where reasonably possible before dispatch. Special-order, custom-finish, made-to-order or specifically imported products may not be cancellable once we have committed to the supplier. If we agree to a cancellation, we may deduct only reasonable costs actually incurred and will explain those costs to you.

This section does not limit any right to cancel or obtain a remedy under the ACL, including where we cannot supply within an agreed or reasonable time.

6. Delivery

Delivery is governed by our Delivery Policy, which forms part of these terms. Delivery dates are estimates unless we expressly agree to a fixed date. We remain responsible for supplying your order and will assist with delayed, lost or damaged deliveries.

7. Faulty, damaged, incorrect or missing goods

Please inspect your delivery when it arrives and contact us as soon as practical if an item is faulty, damaged, incorrect or missing. Prompt notice helps us investigate with the carrier, but a failure to notify us within a stated period does not remove your ACL rights.

If goods fail to meet a consumer guarantee, the available remedy depends on whether the failure is major and on the circumstances. For a major failure, you may reject the goods and choose a refund or replacement, or keep them and seek compensation for the reduction in value. For a failure that is not major, we may choose to repair the goods within a reasonable time. If we cannot or do not do so within a reasonable time, you may be entitled to a replacement, refund or other remedy available under the ACL.

Where an ACL remedy applies, we will arrange or reimburse reasonable return costs. If an item is large, heavy or difficult to return, contact us so we can arrange collection or another appropriate assessment process. We may ask for photographs, serial numbers, proof of purchase and a description of the issue, provided these requests do not unreasonably delay your remedy.

8. Change-of-mind returns

We are not required to accept a return where you simply change your mind. However, for standard-stock goods purchased directly from us, we may accept a change-of-mind return if you contact us within 7 days of delivery and the goods are unused, complete, undamaged and in their original unopened packaging.

Change-of-mind returns require prior approval. You are responsible for return freight and the risk of return transit. Special-order, custom-finish, made-to-order, clearance and specifically imported goods are not eligible unless we agree otherwise. If opened or used goods are accepted at our discretion, a reasonable deduction may be made for any reduction in value and we will explain the basis of that deduction. This change-of-mind policy does not limit your ACL rights.

9. Manufacturer warranties

New products may include a manufacturer warranty with a period and conditions set by the manufacturer. We will provide reasonable assistance with valid warranty claims for products purchased from us. Any manufacturer warranty is additional to, and does not replace, the consumer guarantees under the ACL. Your ACL rights may continue beyond the stated warranty period depending on the nature, price and expected life of the product.

10. Demonstrations, advice and installation

Audio performance depends on system matching, setup, room acoustics, recordings and personal preference. Tell us about any particular purpose or result you require so we can take it into account. Any installation or other service we provide will be carried out with due care and skill and within the agreed time, or otherwise within a reasonable time, as required by the ACL.

11. Website use and intellectual property

Website content is provided for general information and shopping purposes. You must not misuse the website, interfere with its operation, attempt unauthorised access, or use its content unlawfully.

Unless otherwise stated, website text, graphics, branding, photographs and layout are owned by or licensed to Magenta Audio and are protected by intellectual property laws. You may view and print content for personal, non-commercial use, but may not reproduce, distribute or commercially exploit it without permission.

Links to third-party websites are provided for convenience. We do not control those websites and are not responsible for their content, availability or privacy practices.

12. Liability

To the maximum extent permitted by law, we are not liable for loss that was not reasonably foreseeable, or for loss caused by your misuse, unauthorised modification, incorrect installation by another person, failure to follow instructions, or incompatible equipment. This does not exclude liability for our negligence, fraud, wilful misconduct, breach of contract, or failure to comply with a consumer guarantee where liability cannot lawfully be excluded or limited.

You may also be entitled under the ACL to compensation for reasonably foreseeable loss or damage resulting from a failure to comply with a consumer guarantee.

13. Privacy

We handle personal information in accordance with our Privacy Policy and applicable privacy laws. Please review the privacy information linked in the website footer. Payment information is processed by our payment providers in accordance with their terms and privacy practices.

14. Changes to these terms

We may update these terms from time to time. The version applying to a purchase is the version available when the order is accepted, unless a change is required by law or you agree otherwise. Changes will not retrospectively remove rights you have already acquired.

15. Governing law

These terms are governed by the laws of South Australia and the Commonwealth of Australia. You and Magenta Audio submit to the non-exclusive jurisdiction of the courts of South Australia and any courts entitled to hear appeals from them. This does not prevent you from exercising rights available under applicable consumer law in another Australian state or territory.
